TERMS & CONDITIONS

Effective date: January 10, 2025

These Terms and Conditions (“Terms”) govern your access to and use of the website, content, services and communications made available at or through www.maestrolegal.in (the “Website”) by Maestro Legal LLP (a limited liability partnership registered in India) trading as Maestro Legal (Advocates & Legal Consultants) (“Maestro Legal”, “we”, “us”, or “our”).

Please read these Terms carefully. By accessing, browsing, downloading, or otherwise using the Website you acknowledge that you have read, understood and agree to be bound by these Terms (and by the Privacy Policy, Cookie Policy and any other policies posted on the Website, each of which is incorporated by reference).

If you do not agree with any part of these Terms, please do not use the Website.

1. NATURE AND SCOPE

1.1 The Website is provided for general informational and marketing purposes only and contains descriptive material about Maestro Legal’s people, practice areas, publications, events and sample content. Nothing on the Website is intended to be, nor should it be construed as, legal advice, a legal opinion, an advertisement or solicitation for legal work, or an offer to provide legal services to any person. The content is general in nature and does not take into account your specific facts or circumstances.

1.2 Accessing, communicating through, or using the Website does not create an advocate–client or attorney–client relationship between you and Maestro Legal. No confidential or privileged relationship is formed by sending an enquiry or any information to us via the Website unless there is an express, written agreement signed by a partner or authorised representative of Maestro Legal confirming acceptance of an engagement. This is a fundamental point: any communication through the Website is on a non-confidential basis unless Maestro Legal expressly agrees otherwise in writing. Many leading firms adopt similar disclaimers to avoid unintended formation of professional relationships.

1.3 You confirm that you are visiting the Website voluntarily and not in response to any solicitation or advertisement by us. The Bar Council of India Rules prohibit advocates from soliciting work or advertising in any manner; nothing on this Website shall be construed as contravening those professional obligations.

2. FIRM IDENTITY

2.1 Maestro Legal LLP is a limited liability partnership registered under Indian law. For the purposes of these Terms, we may refer to ourselves using our trade name Maestro Legal (Advocates & Legal Consultants). Use of the trade name on the Website is for identification and marketing only and shall not be read as a warranty of suitability for any particular matter.

2.2 Our professional conduct is subject to the Advocates Act, Bar Council of India Rules and other applicable professional conduct rules. Nothing on this Website alters or modifies those statutory or regulatory duties.

3. SCOPE OF INFORMATION

3.1 We have taken reasonable care to present accurate and up-to-date information. However, the law, regulations and factual circumstances change frequently. We make no representation or warranty (express or implied) as to the completeness, accuracy, adequacy, currency or fitness for any purpose of the Website content. You should not rely on the Website as a substitute for independent legal advice tailored to your situation.

3.2 Where the Website contains news, articles, commentary, or summaries of law, these are intended only as general commentary; readers should check definitive primary sources before acting on the basis of any such material.

4. INTELLECTUAL PROPERTY

4.1 All content on the Website (including text, graphics, logos, images, audio, video, design, selection and arrangement of content) is the intellectual property of Maestro Legal or its licensors and is protected by copyright, trademark and other intellectual property laws. You may view, download, and print material from the Website for your personal, non-commercial use only, provided you retain all copyright and proprietary notices. Any other use including copying, reproduction, modification, distribution, republication, posting, transmitting, or creating derivative works is prohibited without our prior written consent.

4.2 If you would like to use any material for a commercial purpose or beyond what is permitted above, contact us in writing at the address set out in Section 18.

5. USER CONTENT

5.1 Do not send confidential, privileged or sensitive information to us through the Website unless you have an existing, signed engagement and are using an authorised channel. Sending unsolicited confidential information does not make the information privileged and Maestro Legal will not be responsible for protecting or returning such submissions unless an engagement is accepted in writing.

5.2 If you submit content or information through forms, contact pages, blogs, or other interactive areas of the Website (each, a “Submission”), you grant Maestro Legal a perpetual, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, adapt, publish, translate and distribute such Submission for any lawful purpose. You represent and warrant that you have the right to grant this license and that the Submission does not infringe any third-party rights.

5.3 We reserve the right (but have no obligation) to monitor, edit or remove Submissions that we determine, in our sole discretion, to be offensive, illegal, infringing, or otherwise objectionable.

6. DATA PROTECTION AND COOKIES

6.1 We collect and process personal data you provide through the Website in accordance with our Privacy Policy and applicable law. Where we process digital personal data, we do so in compliance with the Digital Personal Data Protection Act, 2023 and related rules and guidance; such processing will be limited to lawful bases and purposes, and we will implement reasonable technical and organizational measures to protect personal data. Please review our Privacy Policy for details on what data we collect, how we use it, retention periods, security measures and your rights.

6.2 By submitting personal data you represent and warrant that the data is accurate and that you have the right to disclose it for the purposes expressed. If you are submitting personal data on behalf of another person, you represent that you are authorised to do so and that the recipient has consented.

6.3 The Website uses cookies and similar technologies to improve usability and performance. By continuing to use the Website without changing your cookie settings you consent to such use. Please consult our Cookie Policy for details. Many firms adopt similar cookie and privacy practices (including cookie banners and privacy notices).

7. CONFLICTS OF INTEREST

7.1 The existence of material on the Website does not mean we can or will act for you. Any decision to accept an engagement is subject to conflict checks and professional independence requirements. We reserve the right to decline or withdraw from representation for any reason, including conflicts, regulatory constraints, or for commercial reasons.

7.2 If you believe Maestro Legal may have a conflict in a matter where we represent you, please notify us immediately in writing. We will follow applicable professional rules in addressing any conflict.

8. FEES, BILLING AND PAYMENTS

8.1 Any fee estimates, rate information, or general commentary about billing on the Website are indicative only. Specific fee proposals are subject to negotiation and a written engagement agreement setting out scope, fees, billing procedures and other terms.

8.2 Maestro Legal does not, and will not, request or accept recruitment payments, finder’s fees, or payments in advance for the purpose of obtaining employment. Any demand for such payments in our name is fraudulent — please notify us immediately. (This firm-level warning mirrors common practice and is consistent with professional standards and fraud-prevention measures used by other firms.)

9. THIRD-PARTY LINKS

The Website may contain links to other websites and resources maintained by third parties. Those links are provided for convenience and do not imply endorsement, sponsorship, or approval by Maestro Legal. We have no control over, and do not assume responsibility for, the content, accuracy or availability of external sites. Use of third-party sites is at your own risk. This approach is consistent with standard disclaimers used across the profession.

10. WARRANTIES

10.1 The website and all content, materials, functions and services offered through it are provided “as is” and “as available” without any warranty, express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, title, non-infringement, or arising from course of dealing, usage or trade.

10.2 Maestro Legal does not warrant that the website will be uninterrupted, error-free, or free from viruses or other harmful components. You acknowledge that your use of the website is at your sole risk.

11. LIMITATION OF LIABILITY AND INDEMNITY

11.1 to the fullest extent permitted by applicable law, Maestro Legal (and its officers, partners, employees and agents) shall not be liable for any direct, indirect, incidental, special, consequential, exemplary or punitive damages (including loss of profits, revenue, business, goodwill, or loss of data) arising out of or in connection with your access to or use of the website or reliance on any content, whether based in contract, tort, strict liability or otherwise, even if Maestro Legal has been advised of the possibility of such damages.

11.2 You agree to indemnify, defend and hold Maestro Legal harmless from and against any claim, loss, liability, cost or expense (including reasonable legal fees) arising out of or in connection with (a) your breach of these Terms; (b) your Submission; or (c) your misuse of the Website.

11.3 Nothing in these Terms shall exclude or limit liability that cannot be excluded or limited under applicable law.

12. PAST RESULTS AND TESTIMONIALS

Any descriptions of past matters, case summaries, awards or testimonials on the Website are illustrative and do not guarantee similar outcomes. Results obtained in past matters are not indicative of future results. In adversarial or fact-sensitive areas, outcomes depend on actual facts and applicable law. Do not rely on case summaries as a substitute for independent legal advice.

13. ACCESSIBILITY

13.1 You must not misuse the Website or attempt to gain unauthorised access to the Website or its systems. Prohibited conduct includes transmitting malicious code, attempting to probe, scan or test vulnerabilities, interfering with the Website’s operation, or using the Website to harass, defame or infringe rights of others.

13.2 We reserve the right to suspend or terminate access to the Website for any individual who breaches these Terms or whose conduct, in our reasonable opinion, is inappropriate.

14. INTELLECTUAL PROPERTY CLAIMS

If you believe that any material on the Website infringes your intellectual property rights, please notify our designated agent in writing with sufficient detail for us to evaluate the claim. We will investigate and, where appropriate, remove or disable access to content that is found to infringe rights.

15. CHANGES TO THE WEBSITE AND TERMS

We may modify, update or discontinue any portion of the Website at any time without prior notice. Likewise, we may change these Terms from time to time. The “Effective date” at the top of this page will indicate the last revision. Your continued use of the Website after changes are posted constitutes acceptance of the updated Terms. We recommend you check this page periodically.

16. SEVERABILITY

If any provision of these Terms is held to be invalid, illegal or unenforceable, that provision shall be severed and the remainder of these Terms shall continue in full force and effect to the maximum extent permitted by law.

17. GOVERNING LAW AND JURISDICTION

These Terms are governed by and construed in accordance with the laws of India. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts at Gautambuddh Nagar, unless otherwise agreed in writing. Nothing in this clause shall prevent Maestro Legal from seeking injunctive or other equitable relief in any competent court.
